TUPE (Transfer of Undertakings Protectection of Employment) regulates what should happen to the employees where a business or part of a business is taken over by a third party. The regulations are designed to protect the rights of employees in a transfer situation so that they will enjoy the same terms and conditions as they did prior to the take over.
There are obligations for both the original employment business and the business which is taking over the original employer which need to be complied with. Employees should not be forced to enter into new terms and conditions with the change of employer and need to be consulted at every stage of the transfer.
